The Competition Commission on Wednesday referred three cases of alleged collusive tendering against construction company GVK Siyazama to the Competition Tribunal.
The commission requested that a maximum penalty of 10% of GVK’s yearly turnover in respect of each contravention be imposed.
The first case was between GVK and Neil Muller Construction (NMC) for the Tygervalley Mall, the second was between GVK and NMC on the Akila Trading project, and the third was between GVK and Group Five in respect of Cape Gate Medi-Clinic.
The commission alleged that GVK had bilateral collusive agreements with NMC and Group Five, in which GVK was claimed to have submitted bid prices higher than those of NMC and Group Five to ensure that GVK did not win the tenders.
